Terms of Service

1. Introduction and Scope
These Terms of Service (“Terms”) form an agreement between you and MyDemesne (“MyDemesne,” “we,” “us,” or “our”) and apply when you use the MyDemesne mobile app, the agent and broker portals at mydemesne.app, and the mydemesne.com website (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
These Terms work alongside our Privacy Policy, which explains in detail what information we collect and how we handle it. Where these Terms describe how your data is used, the Privacy Policy controls if there is any conflict.
2. Key Terms
- “Prospect” means an individual using MyDemesne to evaluate and improve their homebuying readiness.
- “Agent” means a licensed real estate professional using MyDemesne's agent-facing tools to support Prospects.
- “Broker” (or “Brokerage”) means a brokerage, or brokerage staff, using MyDemesne's broker portal to manage a roster of Agents.
- “Readiness Signal”means the app's own internal, app-specific estimate of how well-positioned a Prospect appears to be to buy a home. It has no standardized meaning, scale, or value outside the app — it is not a credit score, credit report, official pre-approval, or guarantee of loan eligibility. See Section 7 of our Privacy Policy for the full description and limits of the Readiness Signal.
3. What MyDemesne Is, and Isn't
MyDemesne is a private coaching tool that helps you understand and improve your financial readiness to buy a home. It surfaces information, suggests next steps, and (optionally) connects you with a real-estate Agent.
MyDemesne is not a lender, a financial advisor, a mortgage broker, a credit-counseling service, a consumer reporting agency, or a real-estate brokerage.The Readiness Signal, payment estimates, and recommendations the app shows are educational tools, not professional advice. MyDemesne does not assemble or furnish “consumer reports” under the Fair Credit Reporting Act, and the Readiness Signal is not a credit determination. Final decisions on credit, loans, properties, and Agents are yours alone.
4. Eligibility and Your Account
- You must be at least 18 to use MyDemesne.
- You're responsible for keeping your account secure (Face ID / Touch ID / passcode).
- If you create an Agent or Broker account, the information you provide must be accurate. We may verify license information against publicly available licensing databases. Misrepresenting your identity, license, or brokerage affiliation is grounds for termination.
5. Subscriptions and Billing
- Subscriptions auto-renew monthly until cancelled.
- You can cancel at any time in the app. Your access continues through the end of the paid period.
- If an Agent or Broker sponsors your plan and that sponsorship ends, you get a 14-day grace period to either subscribe directly or end your access (see Section 7.2). Nothing is auto-charged during the grace window.
- All prices are in USD and exclude applicable taxes. Payment is processed by a third-party payment provider, governed by its own privacy policy.
6. Your Data and Privacy
The detailed financial information behind your Readiness Signal — your individual transactions, account balances, and the contents of any credit report you upload — is stored on your own device in an encrypted local database, and is not retained in our databases. We do not claim this data never reaches our servers, because providing certain features requires us to process it in transit:
- Processed by our backend in transit. To connect a financial account and keep it in sync, our backend communicates with our financial-connectivity provider on your behalf, processes the returned data on our servers into the summary figures stored on your device, and returns those summaries to the app. We do not store your individual transactions or balances in our databases.
- Access token held server-side. To maintain a linked financial account, we securely store an access token issued by the connectivity provider. This token is held only on our servers, is never exposed to the app, and can be revoked at any time by disconnecting the account.
- Summaries sent to our AI provider. If you upload a full credit report, its contents are sent to our AI processing provider to extract the data that powers credit coaching. To generate your personalized coaching, we send summary-level figures (not your raw, transaction-by-transaction history) to that provider, which does not train its models on your data and retains it only briefly.

7. Linking and Unlinking
MyDemesne connects three kinds of users — Prospects, Agents, and Brokers. The sections below explain how those connections are formed and ended, and what each party can see while connected.
7.1 Prospects and Agents
- How linking happens. A Prospect links to an Agent by entering or scanning that Agent's unique invite code. The link starts as a pending request, and the Agent must accept it before it becomes active. An Agent may also pre-create a placeholder (an “unlinked” record) for a Prospect they already work with who hasn't installed the app yet; that placeholder converts to a live link once the Prospect installs the app and connects with the Agent's code.
- What an Agent can see while linked. A connected Agent sees only privacy-safe information: an initials- or pseudonym-based identifier, your Readiness Signal and related milestone/task progress, and any contact information you choose to share. An Agent does not receive your linked financial account data, your transaction history, the contents of any document you upload, or any underlying detail behind your Readiness Signal (consistent with Section 6.1 of the Privacy Policy).
- Readiness Signals are for coaching only. They help an Agent who is already working with you (or whom you've chosen to work with) understand your progress. They are not used to screen, qualify, rank, or decide whether to accept you as a client, and Agents are contractually prohibited from using them for any credit, lending, insurance, employment, or housing-eligibility decision (see Section 9).
- How unlinking happens. You can disconnect from an Agent at any time, and an Agent can remove a Prospect from their pipeline. Only one Agent can be actively linked to you at a time; if you link with a different Agent's code, your prior Agent's record is marked transferred.
- What stops, and what is retained. When you unlink, the Agent's forward visibility into your Readiness Signal ends. Past pipeline records are retained in a frozen state (rather than deleted) for dispute-resolution and referral purposes, and are handled in accordance with the retention practices described in Section 10 of the Privacy Policy.
7.2 Agents and Brokers
- How linking happens. A Broker invites an Agent by email. The link forms when the Agent signs up against that invitation, which assigns the Agent to the brokerage. A Broker may sponsor the Agent's subscription (and, in turn, the subscriptions of that Agent's Prospects).
- What a Broker can see. A Broker sees per-agent aggregates only — such as Prospect counts, average readiness, pipeline value, and deal and commission statistics — plus read-only deal pipelines for Agents in their own brokerage. A Broker does not see any Prospect's underlying financial data, and cannot see data belonging to another brokerage. Broker sponsorship of an Agent's subscription does not change this.
- Sponsorship and access changes. If a Broker's (or an Agent's) subscription lapses, downstream access is paused. Affected Prospects receive a 14-day grace period to subscribe directly or end their access before losing Agent-linked features. When the subscription is restored, access resumes.
8. Acceptable Use
You agree not to:
- Use the Service to break a law.
- Reverse-engineer, decompile, or attempt to extract source code from the app or portal.
- Resell, sublicense, or commercially redistribute MyDemesne without written permission.
- Use automated systems to scrape, mirror, or harvest data from any MyDemesne surface.
- For Agents and Brokers: misrepresent a Prospect's readiness or your own credentials, or use Prospect contact information for purposes outside the relationship the Prospect consented to.
9. Agent and Broker Terms
If you use the agent or broker portal, additional terms apply:
- You represent that you hold the licenses required to act as a real-estate Agent or Broker in the jurisdictions where you operate.
- The contact information of any Prospect linked with you is for direct service of that Prospect only. You may not add Prospects to mass-marketing lists, sell their information, or contact them after they release the link.
- You may not use a Readiness Signal — or any information you receive through the Service — to make or inform any credit, lending, insurance, employment, or housing-eligibility decision about a Prospect.
- Broker sponsorship of an Agent's subscription does not entitle the Broker to view the Agent's Prospects' underlying financial data. Brokers see only the per-agent aggregates described in Section 7.2.
10. Termination
You can stop using MyDemesne at any time. You can delete your local data in Settings. For server-side account deletion (Agent / Broker), email [email protected]. On deletion we remove or de-identify your Personal Information within a reasonable period, except where we are required or permitted by law to retain certain records (see Section 10 of the Privacy Policy). We may suspend or terminate accounts for misuse, fraud, or violations of these Terms.
11. Disclaimers
MyDemesne is provided as-is. We don't guarantee that the Readiness Signal or our recommendations match what any specific lender, Agent, or program will offer you. We don't guarantee uninterrupted availability of any third-party data source we rely on.
12. Limitation of Liability
To the maximum extent allowed by law, MyDemesne's total liability for any claim arising from your use of the Service is limited to what you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or incidental damages (e.g. lost profits, missed home purchases, missed loan approvals).
13. Changes
We may update these Terms as the product evolves. If we change something material, we'll update the “Last updated” date and surface the change in the app. Continued use after the change means you accept the new Terms.
14. Governing Law
These Terms are governed by the laws of the State of South Carolina. Disputes that can't be resolved by good-faith discussion will be resolved in courts located in Sumter County, South Carolina.
